Recourse for copyright owners

The Digital Millennium Copyright Act of 1998 ("DMCA") provides recourse for owners of copyrighted material who believe that their rights under U.S. copyright law have been infringed on the Internet.  Under the DMCA, copyright owners may contact the authorized agent of a site with information location tools that refer to infringing material.  Upon receipt of a properly filed complaint satisfying the requirements of the DMCA, Olive Branch Communications, Inc. will remove or block access to the allegedly infringing material.

For your complaint to be valid under the DMCA, your notification of claimed infringement must be a written communication provided to the above designated agent that includes substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
