Use of news stories presented here falls under the Fair Use provision of the Copyright Act of 1976, 17 USC § 107. The four factors to be taken into consideration are:
- The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;
- Pages on The Other Foot (hereinafter TOF) are of a transformative nature.
- The pages are presented as a comment on the original work, and are intended to provoke new insights about International relations.
- It is of the essence that the TOF page visually resemble the original page to present the transformed news item in a credible context.
- Their use is for nonprofit educational purposes.
- The nature of the copyrighted work;
- The copyrighted works are of a factual nature, and TOF pages are commentary on those facts.
- The amount and substantiality of the portion used in relation to the copyrighted work as a whole;
- The pages presented are a small fraction of the original news stories available.
- The effect of the use upon the potential market for, or value of, the copyrighted work;
- There can be no harm to the market of the original, for the original derives its value from being a true representation of events, and a TOF page derives its value from the opposite condition. It is not a direct market substitute for the original.
- The existence of a TOF page is likely to increase traffic to the original page.
- The existence of a TOF page is likely to provide advertising revenue to the copyright owner from the links on the TOF page.

For your complaint to be valid under the DMCA, your notification

- A statement that the information in the notification
is accurate, and under penalty of perjury, that
the complaining party is authorized to act on behalf of
the owner of an exclusive right that is allegedly infringed.
